What is Copyright?

Copyright is a type of Intellectual Property Protection granted to creators of original works the rights to use, reproduce and distribute their own creative works. Copyright protection typically lasts up to 70 years.

Rights Under Copyright Law

  1. Legal Rights: Copyright owners has the legal right to manage, distribute and sell their works. This includes filing copyright infringement claims to take legal action against copycats.
  2. Moral Rights: Copyright owners are entitled to claim works created by themselves as their own. This means receiving credit and acknowledgement when their work is referenced, shared or utilized. Copyright owners are also allowed to prohibit the alteration or misreprentation of their works to preserve its original meaning.
  3. Economic Rights: Copyright owners have the economic rights to reproduce and distribute their works, alongside receiving financial compensation through licensing opportunities.

Copyright Law in Malaysia

Copyright is automatically granted upon the creation of a work, as long as it is recorded in tangible form.

Registration of a creative work with an intellectual property governing body confers additional legal protection in cases of copyright infringement.

In Malaysia, the legal framework for copyright protection is goverened under the Copyright Act 1987.

Copyright owners may use the Copyright Voluntary Notification to provide proof of ownership. Owners shall submit a copy of their work, alongside forms such as CR-3, to MyIPO to obtain the issuance of Certificate.
